Definitions
Words with capitalised initial letters have meanings defined below. These definitions apply whether they appear in singular or plural form.
ApplicationThe FateDate software program, downloadable on any electronic device.
Application StoreThe Apple App Store or Google Play Store from which the Application is downloaded.
AffiliateAn entity that controls, is controlled by, or is under common control with a party — where "control" means ownership of 50% or more of voting securities.
AccountA unique account created for you to access our Service or parts of it.
CountryUnited Kingdom.
CompanyFateDate Ltd, 20 North Road, Loughborough, Leicestershire, LE11 1QJ. Referred to as "we", "us" or "our" throughout.
ContentText, images, or other information posted, uploaded, or made available by you through the Service.
DeviceAny device that can access the Service — computer, phone, or tablet.
FeedbackSuggestions or innovations you send us about the Service.
In-app PurchaseA purchase of a product, item, service, or subscription made through the Application.
ServiceThe Application.
YouThe individual accessing or using the Service, or the entity on whose behalf they do so.
Acknowledgment
These Terms govern your use of the Service and form the entire agreement between you and FateDate. By accessing or using the Service, you agree to be bound by them. If you disagree with any part, you may not use the Service.
You confirm that you are over 18. We do not permit anyone under 18 to use the Service.
Your use of the Service is also subject to our Privacy Policy, which explains how we collect and handle your personal data. Please read it carefully before using the Service.
In-app purchases
The Application may include In-app Purchases allowing you to buy products, services, or subscriptions. All billing and transactions are handled by the Application Store from which you downloaded the app, and are governed by that store's own terms.
In-app Purchases can only be used within the Application and cannot be redeemed for cash or transferred. Once a download has been initiated, it cannot be cancelled.
If a purchase fails or doesn't work after download, we'll investigate and either provide a replacement, issue a patch, or authorise the Application Store to issue a refund up to the cost of the purchase. We will never charge you to replace or repair a faulty In-app Purchase.
For payment issues, please contact the Application Store directly.
User accounts
When creating an account, you must provide accurate, complete, and current information. Providing false information is a breach of these Terms and may result in your account being terminated.
You are responsible for keeping your password secure and for all activity under your account. Do not share your password with anyone. If you become aware of any unauthorised use, notify us immediately.
You may not use a username that impersonates another person, infringes any third party's rights, or is offensive, vulgar, or obscene.
Content
Your right to post content
The Service allows you to post Content. You are responsible for everything you post, including its legality and accuracy. By posting, you grant us a licence to use, display, and distribute that Content through the Service, while retaining your own rights to it.
You confirm that your Content is either owned by you or that you have the right to use it, and that posting it does not violate anyone else's rights.
Content restrictions
You may not post Content that is unlawful, offensive, threatening, defamatory, or otherwise objectionable. This includes, but is not limited to:
- Content that promotes unlawful activity
- Discriminatory or mean-spirited content targeting individuals or groups
- Spam, unsolicited advertising, or chain letters
- Malware, viruses, or any code designed to damage systems or obtain unauthorised access
- Content that infringes patents, trademarks, copyrights, or other proprietary rights
- Impersonation of any person or entity, including FateDate staff
- Content that violates anyone's privacy
- False or misleading information
We reserve the right to remove any Content that we determine, in our sole discretion, violates these Terms — or to limit or revoke access to the Service as a result.
Content backups
While we perform regular backups, we do not guarantee against data loss or corruption. We recommend keeping your own copies of any Content you post. We have no liability for the integrity or restoration of Content.
Copyright policy
We take intellectual property seriously. If you believe Content posted through the Service infringes your copyright, please email our copyright agent at hello@fatedate.co.uk with the following:
- Your electronic or physical signature (or that of an authorised representative)
- A description of the copyrighted work and where it appears
- The URL or location of the allegedly infringing material
- Your contact details
- A statement that you have a good faith belief the use is not authorised
- A statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorised to act on their behalf
On receipt we will take whatever action we deem appropriate, including removal of the challenged content.
Intellectual property
The Service and all original content, features, and functionality belong to FateDate and its licensors. The Service is protected by copyright, trademark, and other applicable laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Your feedback
If you provide us with feedback or suggestions, you assign all rights in that feedback to us. If that assignment is for any reason ineffective, you grant us a perpetual, royalty-free, worldwide licence to use it without restriction.
Links to other websites
The Service may contain links to third-party websites. We have no control over the content or practices of those sites and are not responsible for any damage or loss arising from your use of them.
We strongly recommend reading the terms and privacy policies of any third-party sites you visit.
Termination
We may terminate or suspend your account immediately, without notice, if you breach these Terms. Your right to use the Service ends immediately on termination. To close your account yourself, simply stop using the Service.
Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you have paid through the Service, or £100 if you have made no purchases.
We are not liable for any indirect, incidental, or consequential damages — including loss of data, loss of profits, or business interruption — even if we have been advised of the possibility of such damages.
"As is" disclaimer
The Service is provided "as is" and "as available", without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We make no representations about the accuracy or reliability of any content delivered through the Service.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
Governing law
These Terms are governed by the laws of the United Kingdom. If you are an EU consumer, you also benefit from the mandatory protections of the law of your country of residence.
Disputes resolution
If you have a concern or dispute about the Service, please try to resolve it informally first by contacting us directly. We're always willing to talk.
Changes to these terms
We may update these Terms from time to time. Where a change is material, we'll make reasonable efforts to give at least 30 days' notice before it takes effect. Continuing to use the Service after changes become effective means you accept the new terms.
If you do not agree to revised terms, please stop using the Service.
